Hello Everyone,
I am having trouble getting an indie to agree to guarantee the SUA on Sky main channels. The wording they have proposed is: For the avoidance of doubt, if the Script(s) is/are produced for broadcast on any of the SKY TV channels the Company shall make every effort available to ensure that the SUA shall be payable. If the series is commissioned by a SVOD channel (e.g. Netflix or Amazon) and therefore a primary or co-production deal the parties shall negotiate applicable usage fees in good faith.
They say: we have been consistently advised to use that specific wording in the original draft to cover terms about SKY and SVODs as these are ongoing issues that are still being negotiated. We’ve used this wording with three different agents recently on a variety of agreements and they have accepted its use, even having discussed this with the PMA their end.
Could anyone confirm or deny this? Re the SVods, negotiation at the time is fine but I’m loathe to give Sky any wriggle room to row back on the SUA on their main channels.
